DUI Arrest in Baldwin County, Alabama

If there is suspicion that an individual in impaired, a field sobriety test may be completed at the time of being pulled over. Regardless of the number of drinks consumed, an individual can be arrested for Driving Under the Influence (DUI) in Baldwin County, Mobile County, or Escambia County, Alabama. In Alabama, any individual over the age of 21 whose BAC (blood alcohol content) exceeds .08 is presumed to be driving under the influence of alcohol. In some cases, even if an individual has a BAC less than .08, an officer may still arrest you for DUI.

There are also situations where an individual may be arrested for DUI when no alcohol is involved. If the arresting officer believes the individual is impaired through the use of drugs, that person may be arrested for DUI. While there is not currently a breath test to determine the use of drugs in an individual’s system, a blood test or urinalysis may be required to determine levels present in the driver’s system.

What is considered a DUI in Alabama?

In Alabama, an individual is considered to be driving under the influence if their blood alcohol concentration (BAC) is:

  •  – .04% or higher in a commercial vehicle
  •  – .02% or higher, if under the age of 21

What is “Ignition Interlock”?

According to the Alabama Law Enforcement Agency (ALEA), Ignition Interlock is a device installed on motor vehicles to prohibit individuals from operating the vehicle while under the influence of alcohol. It requires the driver to provide a breath sample before the engine will start and the driver is periodically required to provide breath samples while driving.

What are the penalties if convicted of drunk driving in Alabama?

If you are convicted of a first time driving under the influence (DUI) charge in Alabama, you may receive the following penalties:

A first conviction of a DUI in Alabama may receive the following penalties:

  •  – Up to 1 year imprisonment in a municipal or county jail
  •  – $500 – $2,000 fine, plus an additional $100 fine for the Impaired Drivers Trust Fund
  •  – IID Term: BAC < 0.15 – 90 Days License Suspension/Revocation: 90 Days
  • *Entire suspension is stayed if ignition interlock is voluntarily elected and installed
  • – IID Term: BAC > 0.15 – 1 Year License Suspension/Revocation: 90 Days
  • *Mandatory Ignition Interlock, suspension stayed w/proof of IID installation

A second conviction of a DUI in Alabama may receive the following penalties:

  •  – Mandatory 48 consecutive hours imprisonment or community service of not less than 20 days
  •  – Up to 1 year imprisonment in a municipal or county jail
  •  – $1,000 – $5,000 fine, plus an additional $100 fine for the Impaired Drivers Trust Fund
  •  – IID Term: 2 Years License Suspension/Revocation: 1 Year
  • *After serving 45 days of suspension or revocation, mandatory ignition interlock

A third conviction of a DUI within 5 years in Alabama may receive the following penalties:

  •  – Mandatory 60 day imprisonment which cannot be probated or suspended
  •  – Up to 1 year imprisonment in a municipal or county jail
  •  – $2,000 – $10,000 fine, plus an additional $100 fine for the Impaired Drivers Trust Fund
  •  – IID Term: 3 Years License Suspension/Revocation: 3 Years
  • *After serving 60 days of suspension or revocation, mandatory ignition interlock

A fourth or subsequent conviction of a DUI within 5 years in Alabama is considered a Class C Felony and may receive the following penalties:

  •  – 1 – 10 years imprisonment
  •  – $4,000 – $10,000 fine
  •  – IID Term: 4 Years License Suspension/Revocation: 5 Years
  • *After serving 1 year suspension or revocation, mandatory ignition interlock
